In New York State, if a commercial vehicle is stopped and found to have an out of service violation, the vehicle will be taken off the road and a penalty of $1,000 to $5,000 could be assessed.[1]  Any driver found guilty of an out of service traffic ticket can be fined a minimum of $2,500 up to a maximum of $4,000 for a first offense.[2]  An employer or owner of a commercial vehicle with out of service violations could face fines and penalties of up to $10,000.
