COMMENTS
Fines must be paid at the time of the plea, or the Court will not accept the plea deal. Lawyers do not get an exception to this rule, and should make sure the client has the money or has advanced enough to cover the likely fine. The DA generally negotiates only with lawyers. If the officer does not appear for trial (not the date on the ticket), the Court will usually dismiss traffic charges. A very busy court. Expect to be there for 2-3 hours. Monday nights, mostly for Guilderland traffic court, are not as bad. Attorneys will usually get in and out in less than one hour. Thursday nights, for criminal matters including DWI, can be brutal. Might be smarter to arrive at 6:30 pm.
ABOUT THE AREA
Guilderland is a suburb of Albany NY. The town population is a bit over 30,000. Town Supervisor is Ken Runion. Major highways include I-87 and I-90 (the New York State Thruway and the Northway) and Route 20 (Western Avenue), the latter of which is a very big target for DWI enforcement.
JUDGES
Hon. John Bailey, Denise Randall and Richard Sherwood. All are experienced lawyers.
PROSECUTORS
Usually an Assistant Town Attorney prosecutes traffic tickets and other minor violations written by town officers and State Troopers. U Albany police and Deputy Sheriffs might still prosecute their own traffic tickets. More serious violations including DWI, AUO, shoplifting, etc., are prosecuted by the District Attorney.
TYPE OF CASES
Traffic, DWI, and criminal matters. Court also gets a lot of petit larceny cases from Crossgates Mall, and fake ID and related cases involving college students. The Court also handles small claims up to $3000.
